SCHEDULE OF FEES

Fines for Violation of Declaration of CC&R's, the Association Bylaws or Rules or the ECC Design Guidelines (the Governing Documents):

A. Property Use Restriction Violations. Uncorrected violations of the Governing Documents pertaining to property user restrictions or property maintenance (CC&R's).

1. First violation: $100.00
2. Each month that a violation remains uncorrected an additional fine of $100.00 may be levied.

B. Environmental Regulation Violations. Uncorrected violation of any matters that are under the jurisdiction of the Association Environmental Control Committee.

1. Unauthorized Earthwork and Site Alteration:

a. Grading of lot/putting in trenches without a permit, or authorization: $100.00 and/or restoration to original condition if necessary.

2. Construction Violations:

a. Initiating new construction without ECC approval:
(1) House, garage, additions, multiple or commercial projects: $500.00
(2) Sheds, decks and minor alterations: $100.00
(3) Installation of a fence: $100.00

b. Failure to clean up construction debris: Forfeiture of deposit and/or cost of clean up if done under the direction of the association.

c. Failure to obtain extension prior to expiration of permit: $50.00

d. Failure to obtain final inspection: $50.00

3. Deviation from Approved Plans.
a. Major deviations, under ECC control, without prior approval: $500.00

4. Unauthorized Tree Removal and Limbing without Prior Approval.
a. Tree removal - per tree: $100.00 PLUS:
$25.00 per inch for trees 1" to 10" diameter
$50.00 per inch for trees 10.1" to 18" diameter
$100.00 per inch for trees 18.1" diameter and beyond

NOTE: The diameter will be measured 6 inches above ground level. The fine per inch will be calculated in each category from the first inch.

b. Tree removal from any common area - per tree: $2500.00
c. Limbing of live limbs above 10 feet: $150.00
d. Limbing of live limbs in common area: $500.00
e. Failure to properly dispose of tree or remove debris:

NOTE: Any unauthorized tree removal on a lot may require not only the imposition of a fine as per the above schedule, but also replanting of the tree.

UNDER NO CIRCUMSTANCES SHALL TREES BE REMOVED OR LIMBED OR BRUSH REMOVED FROM COMMON AREA. Any violation of this could result in a fine of $2500.00 per tree and replacement of said tree(s).

5. Vehicles Parked Around the Premises of a Home and Surrounding Area a. Vehicles in violation of Section 8.14(d) of the Governing Documents: $50.00 per month.

6. Debris Surrounding Homes and Common Area: $50.00 per month

7. Miscellaneous Items:
a. Violation of the sign ordinance: $25.00
b. Installation of a fence that does not meet ECC specifications must be removed.

Other violations not listed may also be subject to a fine by the ECC. (the above fines could be assessed per month until corrected.)

The fine policy and schedule of fines may be amended and modified from time to time by the ECC after proper notification and Board approval. Such changes will be posted in the LSPOA paper. Multiple violations may result in multiple fines. Each subsequent violation for the same or similar offense may result in a new fine.
